Throughout these Terms of Service, the terms “Verse & Velvet”, “we”, “us” and “our” refer to Verse & Velvet.

These Terms of Service govern your access to and use of our website, online store, written content, products, digital materials, events, workshops and any other services we make available.

By visiting our website, creating an account, placing an order, subscribing to our communications or otherwise using our services, you agree to these Terms of Service and our Privacy Policy.

If you do not agree to these terms, you must not use our website or purchase our products or services.

Nothing in these Terms of Service excludes, restricts or modifies any right or remedy that cannot lawfully be excluded under the Australian Consumer Law or other applicable legislation.

Verse & Velvet is an Australian platform centred on personal growth, self understanding, emotional insight, identity, healing and transformation.

Our work may include books, journals, digital resources, educational content, workshops, events, speaking engagements and other products or experiences consistent with our purpose.

3. Eligibility

You must be legally capable of entering into a binding agreement to make a purchase through our website.

If you are under the age of majority in your place of residence, you may only use our website or purchase from us with the permission and supervision of a parent or legal guardian.

Certain workshops, events, resources or services may have specific age requirements. Any such requirements will be displayed before purchase or registration.

4. Acceptable use of our website

You agree to use our website only for lawful purposes.

You must not:

  • use our website in a way that violates any applicable law

  • provide false, misleading or fraudulent information

  • attempt to gain unauthorised access to our website, systems or customer accounts

  • interfere with the security or proper operation of our website

  • introduce malicious software, viruses or harmful code

  • scrape, copy, reproduce or commercially exploit our content without written permission

  • impersonate another person or misrepresent your identity

We may restrict or suspend access where reasonably necessary to protect our customers, intellectual property, systems or legal rights.

5. Products and services

We aim to describe and display our products and services as accurately as reasonably possible.

Product photographs and digital previews are illustrative. Colours, textures, dimensions and finishes may appear differently depending on your screen, lighting, device and the manufacturing process.

Books produced through print on demand processes may have minor variations in colour, trimming, binding, paper, alignment or finish. These ordinary manufacturing variations are not necessarily defects.

This does not affect your rights where a product is faulty, materially different from its description, unsafe or otherwise fails to meet a consumer guarantee.

We may update, improve or discontinue products and services from time to time. Any change will not remove rights attached to an order that has already been accepted.

6. Product information and availability

All products and services are subject to availability.

We take reasonable steps to keep descriptions, prices and availability accurate. Occasionally, information may contain an error or a product may become unavailable after an order is placed.

If we cannot supply an ordered product or service, we will contact you and provide an appropriate solution, which may include a replacement, revised timeframe or refund.

We reserve the right to limit purchase quantities where reasonably necessary, including to prevent fraud, misuse, unauthorised resale or inventory disruption.

7. Prices, currency and taxes

Unless stated otherwise, prices displayed on our Australian store are in Australian dollars.

Prices may include or exclude taxes depending on the product, customer location and applicable legal requirements. Any additional amount payable to us will be displayed before you complete checkout.

Shipping charges, where applicable, are calculated and displayed during checkout.

We may change prices for future purchases at any time. A price change will not affect an order that we have already accepted, unless the displayed price was clearly an error and we contact you before fulfilment to offer the correct price or a full refund.

Discounts, promotional codes and special offers are subject to any conditions displayed with the offer. Unless stated otherwise, offers cannot be combined or exchanged for cash.

8. Orders and contract formation

Placing an order is an offer to purchase the selected products or services under these Terms of Service.

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean that the order has been accepted.

An order is accepted when we confirm fulfilment, dispatch the product, provide access to a digital product or otherwise begin delivering the purchased service.

We may decline or cancel an order before acceptance where reasonably necessary because of:

  • product unavailability

  • an incorrect price or product description

  • a payment or security concern

  • suspected fraud

  • a technical error

  • shipping restrictions

  • a breach of these Terms of Service

  • a legal or regulatory requirement

If we cancel an order after payment has been collected, we will refund the relevant amount to the original payment method unless another lawful arrangement is agreed with you.

9. Payment

You agree to provide current, complete and accurate payment and billing information.

Payments may be processed by Shopify Payments, PayPal or another authorised payment provider. Your use of a payment service may also be subject to that provider’s terms and privacy practices.

We do not directly store complete payment card details.

You are responsible for ensuring that you are authorised to use the selected payment method and that sufficient funds are available.

10. Print on demand fulfilment

Some physical products, including books, may be manufactured and fulfilled by Lulu Direct or another print and fulfilment provider.

These products are created after an order is placed. Our fulfilment provider may print, package and dispatch the product directly to you.

Your purchase contract remains with Verse & Velvet. If you experience a problem with an order, contact orders@verseandvelvet.com.au rather than the fulfilment provider. We will investigate the issue and communicate with the provider on your behalf.

The use of a fulfilment provider does not limit your rights under the Australian Consumer Law or other applicable consumer protection legislation.

11. Preorders

Products described as preorders are purchased before their expected release or dispatch date.

Any release, production or delivery date shown for a preorder is an estimate unless expressly stated otherwise. Delays may occur because of production, printing, freight, customs or circumstances outside our reasonable control.

If a material delay occurs, we will provide an update and any options required by applicable law.

If we become unable to fulfil a preorder, we will provide a refund to the original payment method.

A preorder product may be charged at the time the order is placed.

12. Order changes and cancellations

If you need to change or cancel an order, contact orders@verseandvelvet.com.au as soon as possible and include your order number.

Because many of our physical products are printed on demand, production may begin shortly after an order is placed. Once production has begun, we may be unable to cancel the order, change its contents or update its delivery address.

We do not guarantee that a cancellation or amendment request can be completed.

Nothing in this section limits a cancellation, refund or other remedy available to you under applicable law.

13. Shipping and delivery

Delivery estimates are provided in good faith and are not guaranteed delivery dates unless expressly stated otherwise.

Production time and shipping time are separate. Tracking information will generally become available after production is complete and the order has been dispatched.

You are responsible for providing a complete and accurate delivery address. Contact orders@verseandvelvet.com.au immediately if you notice an error. We cannot guarantee that an address can be changed after production or dispatch has begun.

If an order is delayed, lost, damaged or incorrectly delivered, contact orders@verseandvelvet.com.au with your order number and relevant details. We will investigate the issue and provide an appropriate remedy where required.

We are not responsible for delays solely caused by events beyond our reasonable control. However, we will take reasonable steps to assist you and will not exclude any remedy that must be provided under applicable law.

14. International orders

International availability, shipping charges and delivery estimates may vary by destination.

An international order may be subject to customs processing, import duties, taxes, fees or local regulatory requirements.

Unless checkout expressly states that duties and import taxes have been collected, you are responsible for charges imposed by the destination country. These amounts are determined by local authorities and are not controlled by Verse & Velvet.

International customers are responsible for checking whether a product can lawfully be imported into their location.

If an international order is refused, unclaimed or returned because required duties were not paid or an incorrect address was supplied, any refund will be assessed after the product is returned. The refund may be reduced by costs we cannot recover, to the extent permitted by law.

Nothing in these Terms of Service removes any mandatory consumer right that applies in your country.

15. Returns, refunds and consumer guarantees

Our Return and Refund Policy forms part of these Terms of Service and should be read before placing an order.

We do not generally offer refunds for a simple change of mind unless expressly stated in the relevant product listing or Return and Refund Policy.

However, you may be entitled to a repair, replacement, refund, cancellation or other remedy if a product or service fails to meet a consumer guarantee under the Australian Consumer Law or another applicable law.

Our change of mind position does not apply where a product is faulty, damaged, unsafe, materially different from its description, not fit for a disclosed purpose or otherwise fails to meet a statutory guarantee.

We may request reasonable proof of purchase and, where relevant, photographs or information that helps us assess the issue.

  • your full name

  • your order number

  • a description of the issue

  • clear photographs where relevant

  • any other information that may help us investigate

16. Digital products

Digital products may include ebooks, downloadable guides, journals, worksheets, recordings or other electronic resources.

Unless otherwise stated, purchasing a digital product gives you a limited, personal, non exclusive and non transferable licence to access and use it for your own personal purposes.

You must not:

  • reproduce or distribute the digital product

  • share access or download links with another person

  • upload the product to a public or shared platform

  • resell, sublicense or commercially exploit the product

  • alter the product and present it as your own work

  • use the product to train an artificial intelligence system without written permission

Because digital products may be supplied immediately, change of mind refunds are not ordinarily available once access or downloading has begun.

This does not affect your rights if the digital product is faulty, inaccessible, materially misdescribed or otherwise fails to meet an applicable consumer guarantee.

17. Workshops, events and services

Workshops, events, speaking engagements and other services may be subject to additional terms displayed at the time of booking.

These may include:

  • eligibility or age requirements

  • event dates and times

  • venue or online access information

  • participant expectations

  • cancellation and transfer conditions

  • recording or photography notices

  • health and safety requirements

If we cancel an event or service and do not provide a suitable alternative, we will provide a refund for the amount paid directly to us for the cancelled offering.

We may reschedule an event where reasonably necessary. If a material change prevents you from attending, we will provide the options required under applicable law and any specific event terms.

We may remove a participant whose conduct is threatening, abusive, discriminatory, unlawful or seriously disruptive. Any refund will depend on the circumstances and applicable law.

18. Educational and wellbeing information

Verse & Velvet explores topics that may include trauma, emotional wellbeing, identity, relationships, psychology, behaviour, spirituality, religion, personal development and healing.

Our books, articles, resources, social media content, workshops and other materials are provided for general educational and informational purposes.

They are not medical, psychological, psychiatric, legal, financial or other professional advice. They are not a diagnosis, treatment plan or substitute for assistance from a qualified professional who understands your individual circumstances.

Engaging with our content does not create a therapist and client, doctor and patient, lawyer and client or other professional relationship.

Personal growth and healing experiences vary. We do not promise or guarantee a particular emotional, health, financial, relationship or personal outcome.

You are responsible for deciding whether a product, practice or idea is appropriate for you. Seek advice from an appropriately qualified professional where needed.

If you are in immediate danger or experiencing a crisis, contact emergency services or an appropriate crisis support service in your location.

19. Intellectual property

Unless otherwise stated, all content made available through Verse & Velvet is owned by or licensed to us and is protected by intellectual property laws.

This includes:

  • books and written materials

  • website copy and articles

  • digital resources and downloads

  • photographs and visual materials

  • videos, audio and recordings

  • workshop content

  • brand names, logos and design elements

  • graphics, layouts and original concepts

You may access our content for lawful personal use.

You must not copy, reproduce, publish, distribute, sell, modify, translate, adapt, publicly display or create derivative commercial works from our content without prior written permission.

Short quotations may be used where permitted by law and appropriately attributed. Permission is required for uses beyond what the law permits.

“Verse & Velvet” and associated brand elements may not be used in a way that suggests endorsement, partnership or affiliation without written permission.

20. Reviews, comments and submissions

If you submit a review, comment, testimonial, photograph or other material to us, you confirm that:

  • the submission is truthful and based on your genuine experience

  • you own the material or have permission to provide it

  • it does not infringe another person’s rights

  • it is not unlawful, defamatory, threatening, deceptive or discriminatory

  • it does not contain malicious code or confidential information

You grant us a non exclusive, worldwide, royalty free licence to display, reproduce and adapt the submission for operating and promoting Verse & Velvet, subject to applicable privacy and consumer laws.

We will not present a review or testimonial in a misleading way.

We may moderate or remove submissions where reasonably necessary, but we are not required to publish every submission we receive.

21. Third party services and links

Our website may use or link to services operated by third parties, including Shopify, Lulu Direct, payment providers, delivery companies and social media platforms.

Third party websites and services operate under their own terms and privacy practices. We are not responsible for the independent content, security or practices of a third party website merely because we provide a link to it.

When we engage a third party to help fulfil your order, this does not remove our obligations to you as the seller.

22. Privacy and communications

Our collection, use and disclosure of personal information are governed by our Privacy Policy.

By providing your email address for an order, you consent to receiving communications reasonably necessary to process and fulfil that order.

Marketing communications will only be sent where permitted by law. You may unsubscribe from marketing emails at any time by using the unsubscribe link or contacting us.

Unsubscribing from marketing does not prevent us from sending essential transactional messages about an active order, account or service.

23. Security and customer accounts

You are responsible for maintaining the confidentiality of your account credentials and for activity conducted through your account.

Notify us promptly if you believe your account or payment information has been used without authorisation.

We take reasonable measures to protect our systems, but no online platform can guarantee complete security or uninterrupted availability.

24. Consumer guarantees

Our goods and services may come with guarantees that cannot be excluded under the Australian Consumer Law.

Nothing in these Terms of Service is intended to exclude, restrict or modify:

  • a consumer guarantee

  • a statutory warranty

  • a condition or right implied by law

  • any liability that cannot lawfully be excluded or limited

Where legislation permits us to limit a remedy, the limitation will apply only to the maximum extent permitted by that legislation.

25. Liability

To the maximum extent permitted by law, Verse & Velvet is not liable for indirect or consequential loss arising solely from your use of the website or reliance on general educational content.

This limitation does not apply to liability that cannot lawfully be excluded, including liability arising under the Australian Consumer Law.

We are not responsible for loss caused by:

  • your failure to follow reasonable instructions

  • inaccurate information supplied by you

  • unauthorised or unlawful use of our products or website

  • a third party service that is outside our reasonable control

Nothing in this section limits our responsibility for our own conduct, an accepted order or a remedy that the law requires us to provide.

26. Suspension and termination

We may suspend or terminate access to our website or services where reasonably necessary because of fraud, unlawful conduct, a serious breach of these terms, a security threat or conduct that places another person at risk.

Where practical and appropriate, we will provide notice and an opportunity to resolve the issue.

Termination does not affect rights and obligations that arose before termination, including payment obligations, intellectual property rights and statutory consumer rights.

27. Changes to these Terms of Service

We may update these Terms of Service to reflect changes to our operations, products, technology or legal obligations.

The updated version will be published on this website with a revised “Last updated” date.

Changes will apply from the date they are published. They will not retrospectively remove rights attached to an order made before the change.

Your continued use of the website after an update means that the updated terms apply to future use and future purchases.

28. Severability

If a provision of these Terms of Service is found to be unlawful, invalid or unenforceable, that provision will be limited or removed only to the extent necessary.

The remaining provisions will continue to operate.

29. No waiver

If we do not immediately enforce a right under these Terms of Service, that does not mean we have waived that right.

30. Entire agreement

These Terms of Service, together with our Privacy Policy, Return and Refund Policy, Shipping Policy and any specific terms shown for a product, service or event, form the agreement between you and Verse & Velvet.

If specific product or event terms conflict with these general terms, the specific terms will apply to that product or event to the extent of the inconsistency, subject to applicable law.

31. Governing law

These Terms of Service are governed by the laws of Victoria, Australia and applicable Commonwealth laws.

You and Verse & Velvet submit to the jurisdiction of the courts of Victoria and any courts entitled to hear appeals from them.

If you live outside Australia, this section does not remove any mandatory consumer protection available to you under the laws of your place of residence.
